Pivotal Path Nursing Practice LLC is a private, consultative nursing practice located in The Woodlands, Texas. We provide independent patient advocacy, healthcare navigation, education, and care coordination services provided at the patient’s direction. We do not provide medical diagnosis, treatment, or hands-on clinical care.

2. INFORMATION WE COLLECT

When you contact us, schedule a consultation, or engage our services, we may collect:

  • Your name, address, phone number, and email address
  • Date of birth and demographic information
  • Health history, current health conditions, and medications — to the extent you share them with us for care coordination purposes
  • Information about your healthcare providers, including names, specialties, and contact information
  • Insurance information (if applicable)
  • Notes and records created during our consultation and support sessions

  • Billing and payment information

With your written authorization, we may receive health-related information from your healthcare providers to facilitate care coordination.

4. PROTECTED HEALTH INFORMATION — TEXAS LAW

Because we handle health-related information in the course of providing care coordination and consultative nursing support, we are classified as a “covered entity” under Texas Health & Safety Code Section 181.001. This means we are subject to Texas medical privacy requirements regardless of whether we bill insurance or qualify as a HIPAA covered entity. Regardless of our precise classification, we apply the protections required by Texas medical privacy law to all health-related information we handle.

We may disclose your PHI without authorization in limited circumstances permitted by law, including:

  • When required by court order or subpoena
  • For public health reporting as mandated by law
  • To prevent a serious and imminent threat to health or safety
  • As otherwise required by federal, state, or local law

5. HIPAA APPLICABILITY

Pivotal Path may or may not qualify as a “covered entity” under the federal Health Insurance Portability and Accountability Act (HIPAA), depending on whether we transmit health information electronically in connection with standard transactions (such as insurance claims). Regardless of our HIPAA status, we voluntarily apply HIPAA-level safeguards to all health information we handle, and we comply fully with the Texas Medical Records Privacy Act, which imposes comparable or stronger protections.

If we enter into arrangements with HIPAA-covered healthcare providers to perform services on their behalf, we will execute Business Associate Agreements as required and comply with all applicable HIPAA obligations in that capacity.

6. HOW WE SHARE YOUR INFORMATION

We do not sell, rent, or trade your personal or health information. We share information only in the following circumstances:

  • With your healthcare providers, with your written authorization, for care coordination purposes
  • With service providers who assist us in operating our business (e.g., payment processors, IT support), subject to contractual obligations to protect your information

  • To protect the rights, safety, or property of Pivotal Path, our clients, or the public
  • As otherwise permitted or required under Texas or federal law

7. YOUR RIGHTS

  • Access: You have the right to request access to the personal and health information we hold about you.
  • Correction: You have the right to request that we correct inaccurate or incomplete information.
  • Restriction: You may request that we restrict certain uses or disclosures of your health information.
  • Authorization and Revocation: We will obtain your written authorization before using or disclosing your protected health information for purposes not described in this policy, and you may revoke any such authorization in writing at any time.
  • Complaint: You have the right to file a complaint if you believe your privacy rights have been violated, without fear of retaliation. You may file a complaint with us or with the Texas Attorney General.
  • Electronic Health Information: Under Texas law, you have the right to receive your health information in electronic form, if we maintain it electronically.

Our consultative services may involve support for families with minor children; in those cases, a parent or legal guardian provides authorization and consent for any information shared with us regarding the minor.

Our services are strictly consultative and non-treating:

  • All medical decision-making remains with your licensed physicians.

7-Year Record Policy

In accordance with Texas medical record retention rules, client consultative records are securely stored for a minimum of seven (7) years following the conclusion of services.
